Kiddushin, Daf Nun Het, Part 2

 

Introduction

The mishnah rules that if the man sells any of the items mentioned in the mishnah and then betroths with them, the woman is betrothed. The Talmud asks how we know this rule.

 

מכרן וקידש בדמיהן מקודשת

מנלן מדגלי רחמנא בעבודת כוכבים (דברים ז, כו) והיית חרם כמוהו כל שאתה מהייה הימנה הרי הוא כמוהו מכלל דכל איסורים שבתורה שרו

 

If he sells them and betroths her with the proceeds, she is betrothed.

How do we know this? Since the Torah revealed in reference to idolatry, And you shall be banned like it (Deuteronomy 7:26) [which means,] whatever you produce out of it is as itself, it follows that all other objects forbidden in the Torah are permitted.

 

The rabbis read the Torah as ruling that idols or things used in idolatrous worship are prohibited and if they are used to produce something else, then whatever is used for the purchase is prohibited as well. But since the Torah specifies this about idolatrous objects, by implication other prohibited items are different. In other cases, if the item is sold, the proceeds can be used.

 

ונילף מינה משום דהוה עבודת כוכבים ושביעית שני כתובים הבאים כאחד וכל שני כתובים הבאים כאחד אין מלמדין

 

Let us learn from it? Because idolatry and seventh year [produce] are two verses that come with the same teaching, and any two verses that come with the same teaching do not teach [about others].

 

The Talmud asks why idolatry shouldn t be a paradigm for everything else. The answer is that there are two objects that have the same rule (the proceeds of their sale are prohibited). Idolatry and seventh year produce. And in any such case, neither serves as a paradigm for other things.

 

עבודת כוכבים הא דאמרן שביעית מאי היא (ויקרא כה, יב) יובל היא קודש תהיה לכם מה קודש תופס את דמיו אף שביעית תופסת דמיה

אי מה קודש תופס את דמיו ויוצא לחולין אף שביעית תופסת דמיה ויוצאה לחולין תלמוד לומר תהיה בהוייתה תהא

 

Idolatry, as stated. What is the source about seventh year [produce]? It is the Jubilee; it shall be holy to you (Leviticus 25:21): just as a holy thing transfers its holiness to the purchase money, so does seventh year [produce] likewise transfer holiness to its purchase money.

If so, just as a holy thing transfers it holiness to the purchase price but itself becomes hullin, so would the seventh year [produce] transfers it holiness to the purchase price but itself becomes hullin? Scripture says: It shall be, [meaning], it shall remain in its present form.

 

If seventh year produce is sold, the money used to buy it becomes holy but the seventh year produce is not desacralized.

 

כיצד לקח בפירות שביעית בשר אלו ואלו מתבערים בשביעית בבשר דגים יצא בשר נכנסו דגים בדגים יין יצאו דגים נכנס יין ביין שמן יצא יין נכנס שמן הא כיצד אחרון אחרון נתפס בשביעית ופירי עצמו אסור

 

How so? If one buys meat with seventh year produce, both must be removed [from the house] in the seventh year; [if he trades the] fish for meat, the meat passes out [from the status of seventh year produce] and the fish enters [takes its place]; [if he trades] the fish for wine, the fish passes out and the wine enters; oil for the wine, the wine passes out and the oil enters. How is this so? The last one takes [the nature of] the seventh year produce, while the [original] produce itself remains forbidden.

 

This baraita illustrates how the seventh year produce retains its status and yet passes on its status to whatever is purchased through it.

 

הניחא למאן דאמר אין מלמדין אלא למאן דאמר מלמדין מאי איכא למימר

מיעוטי כתיבי כתיב הכא (דברים ז, כו) כי חרם הוא וכתיב התם (ויקרא כה, יא) יובל היא היא אין מידי אחרינא לא

 

Now, that makes sense to the one that holds that [two verses that come to teach the same thing] do not teach about [others]; but on the view that they do, what can be said?

Limitations are written. Here it is written: and you shall be banned like it and there it is written, It is the Jubilee : only it, but nothing else.

 

Other rabbis hold that one can learn from two verses that teach the same thing. So how do they know that only idolatry and seventh year produce cause the money used to purchase them to become prohibited? They learn it from the word it that appears in both verses. It has this rule, but nothing else.
