Kiddushin, Daf Nun Het, Part 1

 

Introduction

This week s daf continues to discuss hullin, non-sacred animals, slaughtered in the Temple Courtyard. Last week we learned that it is forbidden to derive benefit from such animals.

 

אשכחינהו מר יהודה לרב יוסף ולרב שמואל בריה דרבה בר בר חנה דהוו קיימי אפיתחא דבי רבה

אמר להו תניא המקדש בפטר חמור בבשר בחלב ובחולין שנשחטו בעזרה ר’ שמעון אומר מקודשת וחכ"א אינה מקודשת אלמא חולין שנשחטו בעזרה לר’ שמעון לאו דאורייתא

 

Mar Judah met R. Joseph and R. Shmuel, son of Rabbah b. Bar Hanah, standing by the door of Rabbah s academy. He said to them: It was taught: If one betroths [a woman] with the firstborn of a donkey, meat [cooked] in milk, or hullin killed in the Temple Courtyard, R. Shimon holds: She is betrothed; while the Sages says: She is not betrothed.

This proves that hullin killed in the Temple Courtyard to R. Shimon is not biblically forbidden.

 

R. Shimon holds that if a man betroths a woman with hullin killed in the Temple Courtyard she is betrothed. This implies that he holds that this is not a biblical prohibition.

 

ורמינהו ר"ש אומר חולין שנשחטו בעזרה ישרפו וכן חיה שנשחטה בעזרה

 

And they raised the following contradiction against it: R. Shimon said: Hullin that was killed in the Temple Courtyard must be burned, and likewise a wild beast killed in the Temple Courtyard!

 

In this baraita, R. Shimon mandates the utter destruction of hullin killed in the Temple Courtyard. This implies that the prohibition is biblical.

אתו לקמיה דרבה אמר להו פלגא אוקמינכי הב"ע כגון שנשחטה ונמצאת טריפה ור"ש לטעמיה דתניא השוחט את הטריפה וכן השוחט ונמצאת טריפה זה וזה חולין בעזרה ר"ש מתיר בהנאה וחכמים אוסרים

 

They were silent. When they came before Rabbah [and put the difficulty to him], he said to him: A divisive person [Mar Judah] has stood [this question] up to you! What are we dealing with here? For instance it was killed and found to be a trefa. And R. Shimon follows his own view. For it was taught: If one kills a trefa, or if one kills [an animal] and it is discovered to be a trefa, both being hullin in the Temple Courtyard: R. Shimon holds that benefit is permitted; but the Sages forbid it.

 

R. Joseph and R. Shmuel do not know how to answer Mar Judah s question, so they bring it to Rabbah. After denigrating Mar Judah for his contentious personality, Rabbah solves the problem. R. Shimon holds that hullin animals killed in the Temple are biblically prohibited. But the baraita was referring to a case where the animal was found to be a terefa, an animal with a physical flaw that would have caused it to die. Such an animal could not be a sacrifice. Since its slaughter would in any case not have permitted it to be eaten, R. Shimon does not consider this to be under the prohibition of hullin killed in the Temple.
