Kiddushin, Daf Kaf Zayin, Part 1
Introduction
This week s daf continues to discuss whether when transferring movables through the transfer of land, the movables must be heaped on the land.
תא שמע מעשה ברבן גמליאל וזקנים שהיו באים בספינה אמר להם רבן גמליאל לזקנים עישור שאני עתיד למוד נתון לו ליהושע ומקומו מושכר לו ועישור אחר שאני עתיד למוד נתון לו לעקיבא בן יוסף כדי שיזכה בו לעניים ומקומו מושכר לו ש"מ בעינן צבורים בה שאני התם כי היכי דלא ליטרחינהו
Come and hear: Rabban Gamaliel and some elders were once travelling in a ship. Rabban Gamaliel said to the elders, The tithe which I in the future will measure out will be given to Joshua, and its place [where it is lying] is rented to him; and the other tenth which I am to measure out, let it be given to Akiva b. Joseph, that he shall acquire it on behalf of the poor, and its place be rented to him.
This proves that they must be heaped on it.
[No:] there it was different, for he did not wish to trouble them.
In this story, Rabban Gamaliel wants to eat his produce but tithe it by setting aside produce not on the ship. This way he can eat all the food on the ship. He declares that the first tithe will go to R. Joshua (who is a Levite) and the poor tithe will go to Akiva b. Joseph, who is poor. To transfer them the produce, he rents the space to them so that they can acquire it. This seems to prove that to transfer movables, the movables must be on the land being transferred.
The Talmud rejects the proof. He might have rented them this property just so they could leave the tithes there for a while.
